- Information on how to enter and prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.
- The promoter is Telstra Corporation Limited ABN 33 051 775 556 of 400 George Street, Sydney, NSW, 2000 ("Promoter").
- The Promotion will be open from 12.00 pm Australian Eastern Standard Time (“AEST”) on 12 April 2011 and will conclude at 5.00 pm AEST on 20 April 2011 ("Promotion Period")..
- Entry is open to all Australian residents, aged 18 years and over, other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promotion (including supplier of prizes), and their immediate families who are directly associated with the Promotion (“Eligible Entrants”).
Entry
- To enter and be eligible to win, Eligible Entrants must, during the Promotion Period (all steps must be completed in the one transaction):
- visit the Promoter’s corporate blog, located at http://exchange.telstra.com.au ("Website");
- answer the following question in 25 words or less: “Why you’d love faster mobile Wi-Fi in more places?” (“Entry Question”); and
- correctly complete and submit the online entry form, providing personal details including full name, address, phone number, State of residence and email address.
("Eligible Entry").
- Eligible Entrants who submit an Eligible Entry will be automatically entered into the Promotion. Only one entry per Eligible Entrant will be accepted.
- Judging of all Eligible Entries received during the Promotion Period will take place between 18 April 2011 and 20 April 2011 ("Judging Period"). The judging will take place at Level 11, 400 George Street, Sydney, NSW 2000 (“Judging Location”). The judging will be conducted by representatives of the Promoter (“Judges”).
- The five (5) Eligible Entrants deemed by the Judges, in the Judges’ sole and absolute discretion, to have the most creative, original and entertaining answer to the Entry Question will each win from the Promoter a prize pack, valued at up to $129.00 (including GST), consisting of:
- 1 x Telstra Elite® Pre-Paid Elite® Mobile Wi-Fi device with 5GB of data (to use within Australia in 90 days).
- This is a game of skill. There is no element of chance in the judging of the Promotion or determination of the winners.
- The Prize winners will be notified by telephone and email on 29 April 2011. The winners’ details will be published on the Website by 29 April 2011.
- Any prizes which have not been claimed by 9:00 am AEST on 6 May 2011 will be forfeited and distributed at the Promoter’s absolute discretion.
General
- The total Prize pool value is up to $ 964.00 (GST inclusive).
- The Prize is not transferable or exchangeable and is not redeemable for cash.
- The Telstra Elite Pre-Paid Wi-Fi device is locked to the Telstra Next G network and fees will apply if the prize winner unlocks the device for use with another network. All other costs associated with the Prize, including but not limited to connection to any other network is the responsibility of the winner.
- The Prize Winners must comply with all separate terms and conditions regarding use of the Prize including compliance with the requirements of clause 16 below. If Winners do not complete, sign and return and the forms required pursuant to clause 16 they will not be eligible to receive their Prize. Once Prize Winners have complied with clause 16 they will be sent their Prize.
- All Prize Winners must comply with Telstra’s standard identification checks for Pre-Paid Mobile and Internet Services to be eligible to receive their Prize. A Prize Winner will not be eligible to take the Telstra Elite Pre-Paid Mobile Wi-Fi if:
- They do not complete, sign and return the Australian Mobile Telecommunications Association form provided by the Promoter by 9:00am AEST on 6 May 2011; or
- They do not show (or provide a clear copy) of their current identification (as outlined in the Australian Mobile Telecommunications Association form) to the Promoter by 9:00am AEST on 6 May 2011.
- The Prize winners must each be Australian residents 18 years or over to receive the Prize.
- The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or tampered with in any way before it reaches the winner.
- The Promoter accepts no responsibility for any variation in the value of the Prize.
- If the Promoter is unable to provide the winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of equal or greater monetary value.
- If a winner chooses not to take the Prize or any component of it (or is unable to), they forfeit the prize and the Promoter is not obliged to substitute the Prize or any component.
- The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
- The judges’ decision is final and binding and no correspondence will be entered into. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
- If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available.
- Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
- Telstra Employees who are in breach of the Telstra terms and conditions before the Judging Period will be ineligible to win. These terms and conditions are available at http://www.telstra.com.au/customerterms/docs/infoservices.pdf.
- The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry and the Promoter’s decision in relation to any aspect of the Promotion is final and binding on each person who enters. No correspondence will be entered into.
- By entering the Promotion, the entrant understands and agrees that the Promoter may use and disclose the information provided by the entrant on the terms and for the purposes (including marketing) set out in the Promoter’s Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059, as if they were a customer of the Promoter. The entrant agrees that the Promoter can continue to contact them even after this Promotion ends. If the entrant would like to access or correct the personal information that the Promoter holds about the entrant, or if the entrant does not wish the information to be disclosed, the entrant should advise the Promoter by phoning 1800 039 059.
- By entering into the Promotion, the entrant agrees and acknowledges that:
- they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of them;
- the Promoter may use such comments or photos (the “Materials“) for the Promoter’s future promotional and marketing purposes without further reference or compensation to them;
- the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
- they acknowledge that, by entering the Promotion, they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
- they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (“Moral Rights“);
- they waive all Moral Rights in the Materials that arise outside Australia; and
- they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
- To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or indirect loss) or personal injury suffered or sustained in connection with this Promotion.
- The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize.
